• On September 24, 2024 a Douglas County, Nebraska Sheriff's Deputy Coffey, badge #5452 served Ed and Dora with Notice to Vacate under a Praecipe for Writ of Restitution signed by Douglas County, Nebraska District Court Judge Duane C. Dougherty. As a means to help the opposing counsel Matthew Saathoff #24321 who owns the Saathoff Law Group, PC, LLO located at 440 Regency Parkway Drive #132 in Omaha, NE 68114 to UNLAWFULLY commit fraud, Judge Dougherty implemented Jim Crow Laws into the Defendant's Ed and Dora's Douglas County District Court Case CI 18 9530. Jim Crow Laws restrict Black American's from owning real estate property, from being involved in litigation against White's and any evidence or testimony offered at a trial is inadmissible. Evidence will show that it was because Judge Duane C. Dougherty applied these JIM CROW LAWS in our case that the Douglas County, Nebraska Sheriff's Department served this Notice to Vacate. America, Nebraska harbors a system that discriminates against Black American's and Judge Duane C. Dougherty's implementation of JIM CROW LAWS in this case offers this proof.

• Barbara Humphrey's May 29, 2020 Deposition disclosed a wealth of information including Donald Humphrey's forgiveness of the loan made to Ed. Barb's testimonials under oath disclosed false statements she'd made under No. 25 from the Plaintiff's Answers to Defendants' Interrogatories as well as disclosing false statements her counsels prepared and presented under lines 2 and 5 from the Plaintiff's Affidavit for Transfer of Real Property without Probate. Additionally, these testimonials under oath disclosed fabricated evidence pertaining to a forged Amortization Schedule her daughter forged on October 5, 2018, and misrepresented facts from other statements made that were critical in this case that were intentionally overlooked or ignored by Judge Duane C. Dougherty.

• America, on September 26, 2018 Nebraska attorney John C. Chatelain  of Chatelain & Maynard Law Firm 440 Regency Parkway Drive #132, Omaha, NE 68114, UNLAWFULLY prepared and presented this fraudulent Affidavit for Transfer Real Property without Probate to the Douglas County, Nebraska District Court on behalf of his client Barbara J. Humphrey against Ed's real estate property. The issue is that it contain false statements under lines 2 and 5. Under line 5 this Affidavit claimed "I am entitled to the real property per the will of the deceased and I have made an investigation and have been unable to determine any subsequent will." Folk's this is what one might call a White face lie.
• Before filing her false statements in this Affidavit, Barbara J. Humphrey had known her claim was fraudulent. She had known that the will she was claiming existed, in fact did not exist. 
• Evidence will prove that during trial Barbara Humphrey admitted that Ed's real estate property had not been in the will as false statements had claimed. During trial on April 10th, 11th and May 23, 2023, Douglas County, Nebraska District Judge Duane C. Dougherty sat on his bench listing to Barbara's admit that Ed's real estate property wasn't in will. Judge Dougherty sat listing as Barbara admitted that there was no will. But in the end. and at the sway of Nebraska attorney Matthew P. Saathoff owner of The Saathoff Law Group; Judge Dougherty ORDERED a Writ of Restitution and Douglas County Sheriff Deputy Coffey 5452 served Ed with a Notice to Vacate real estate property solely owned by Ed.
• This is the power of JIM CROW LAWS and White LIES.

• On September 26, 2018 Nebraska attorney John C. Chatelain, Chatelain & Maynard Law Firm which is inside The Saathoff Group located at 440 Regency Parkway Drive #132, Omaha, NE 68114, prepared and presented this Real Estate Transfer Statement and filed this fraudulent document with the Douglas County, Nebraska Register of Deeds office. The issue is, is that Mr. Chatelain relied upon false statements obtained from Barbara J. Humphrey's fraudulent Affidavit for Transfer of Real Property without Probate in filing this document. Additionally, Mr. Chatelain had no color of authority not the consent of the owner Ed to make changes to Ed's title. 

• Under Interrogatory No. 25 from the Plaintiff's Answers to DEFENDANTS' INTERROGATORIES, Nebraska attorney John C. Chatelain #15925 Chatelain & Maynard Law Firm within The Saathoff Law Group located at 440 Regency Parkway Drive #132, Omaha, NE 68114 asked his client Barbara Humphrey to:  
• Describe ANY and ALL discussions or communications between Edward XXXX and any person regarding any loan, payment of loan, or ownership of the subject property including, who was the speaker, who was present for such discussion or communication.

To this, whomever answered John Chatelain's question had (only) given TWO answers: 

• (1) After house was purchased, Ed Don and Barb sat down and discussed repayment of the loan at Humphrey's home.
• (2) On September 6, 2018, after Don died, Ed, Barb and Elizabeth had a discussion.
• 
  
• America, neither of these accounts ever took place.
• However, Barbara Humphrey withheld information of the meeting that actually had taken place where Don, Ed, Dora and herself had a meeting where the loan was forgiven.
• In her May 29, 2020 deposition Barbara testified as follows:
• 46:16-18 Ed: I'm getting to a point here Okay? When I explained that to him, the first thing he said was that we can afford to go up to ten; am I correct?
• 46:19 Barbara: Yes.
• 46:20 Ed: And it angered you?
• 46:21 Barbara: Yes
• 46-22-24 Ed: The first words out of your mouth was, oh, so he's got the house and he's getting a new truck. And with that you jumped up and you ran out the front door; am I correct?
• 46:25; 47:1 Matthew Saathoff: Listen to his question, and answer his question. 
• 47:2-3 Barbara: I was upset with that statement, yes. I went to the front door.
• 47:4 Ed: You went out the house?
• 47:5 Barbara: I went out the house, yes.
• Under cross-examination
• 80:15-16 Matthew Saathoff: Did you ever make the statement, "So he has a house and a car?" Yes or no?
• 80:17 Barbara: A house and a truck.
• 80:18 Matthew Saathoff: A house and a truck.
• 80:19 Barbara: Yes.
• 80:20 Matthew Saathoff: Okay. And what did you mean by that?
• 80:21-25 Barbara: Well, Don had wanted to give him the house, the 25,000 that he put up front for the house. And the $10,000 was towards the truck, etc...

1. Over the objections of his wife Barbara Humphrey, his daughter Elizabeth Humphrey and son in law Joe Hendrick's. Donald W. Humphrey "now deceased," made a loan to Ed in the amount shown as $25,219.92. Below shows a copy of the Cashier's Check which was used for purposes of helping Ed to purchase the subject Real Estate property at issue in the Douglas County, Nebraska District Court Case No. CI 18 9530 Lawsuit against Ed and Dora. Evidence from Barbara's own trial testimonials offer proof that Don acted as the mortgage holder (only), when making this loan to Ed. Don's name was placed on the property's title (only), until Ed  repaid the loan in full. At which time Donald Humphrey's name would be remove from the title and Ed would become sole owner of the property. However, before Don's death on August 24, 2018, Don, Ed, Dora and Barbara were gathered in a meeting at the Humphrey's residence. During this meeting Barbara had been seated to the right side of Don within 3 feet . While sitting in the presence of his wife Barbara, Don forgave the remainder of the loan at issue in this case. On May 27, 2022 the opinion's of The Nebraska Supreme Court acknowledged that if Don did indeed forgive the  loan, that this forgiveness had acted as a relinquishment of any ownership interest Don may have held in the subject property and that his relinquishment had left Ed as sole owner of the Real Estate property. Evidence from Barbara Humphrey's May 29, 2020 Deposition discloses facts of this meeting having taken place as well as Don's forgiveness of the loan which at the time had angered Barbara and caused her to jump up from her seated position and run out of her front door. Further, evidence from Barbara's May 23, 2023 trial testimonials had once again acknowledged this meeting had taken place and her reactions to Don's forgiveness of the loan relinquished his interest as the property's mortgage holder. 

1. This Special Warranty Deed is a copy of the original document which listed both  Donald W. Humphrey and Edward J. Smith as the property's owners. (Address whited out). As orally agreed, Donald Humphrey's name had been added to the Deed for security reasons but (only) until Ed repaid the loan in full. Somewhere around mid June to mid July 2018, Don forgave the remainder of the Loan relinquishing any interests he may have held in the real estate as the mortgage holder. 

• After Donald Humphrey forgave Ed for the remainder of the outstanding loan, Don then instructed his wife Barbara Humphrey to write Ed a check in the amount of $10,000. This money was meant to replace an older pickup truck that he'd gifted Ed and that his wife Barbara, daughter Elizabeth Humphrey and Joe Hendrick's had towed away from Ed's property and sold. Barbara wrote this $10,000 check on August 8, 2018. Since Elizabeth, Joe and Barb conspired to take back the gifted Chevy Silverado this $10,000 was gifted to Ed for purposes of buy another truck which can be viewed as #6 2007 Ford F150 SuperCab XLT.

Meant to replace an older model Chevy Silverado towed and sold by his family members, Don gifted Ed with $10,000 for purposed of purchasing the truck shown here.
